Abstract

Criminal liability for perpetrators of maltreatment causing death is an important issue in Indonesian criminal law. Persecution that leads to the death of a person does not only contain elements of physical violence, but also involves fatal consequences that lead to loss of life. In this context, the perpetrator may be subject to criminal sanctions in accordance with the applicable provisions in the Criminal Code (KUHP), specifically related to the crime of murder or maltreatment causing death. This study aims to examine the legal aspects of criminal liability against perpetrators of maltreatment that results in death, both in the realm of investigation, prosecution, and in the consideration of judges in imposing sentences. In addition, this study also explores the factors that influence the criminal liability process, including the elements of intent, negligence, and other special conditions such as self-defense or provocation. Through normative juridical analysis, it is expected to provide a deeper understanding of how the Indonesian criminal justice system handles cases of persecution that lead to death, as well as the legal implications received by perpetrators in order to uphold justice in society.
